Dear All please find attached below an e mail to County Council who are ultimately responsible for the state of the footpath leading up to the crossing

 

Dear Sir or Madam

 

Thank you for the response which was given in hexadecimal and protected by three passwords none of which enabled me to access your reply and as I do not have the luxury of the services of GCHQ, I was wondering whether someone could please simply reply in open format, as opposed to this ridiculous level of security which presumably as a rate payer I am contributing to.

 

No doubt some smart security expert with high level links to your computer dept sold this product to the County Council, when quite obviously in the vast majority of cases it is completely unnecessary

 

Unfortunately we are now in School term and the path if anything is even worse, very slippery, covered in mud and the aforementioned hole is now MUCH bigger and a definitive trip hazard. As this path is used by school mums on a daily basis I would hate to think that the County get sued for any accident which arises who would then have to sue the engineering company concerned.

 

This e mail will be shortly posted on the Spooner row message board so that there is no doubt about it being in the public domain and when it was sent.

 

Could I ask that the matter be resolved and if you are going to respond a simple e mail reply will suffice.

 

I also note the platforms on both sides remain a building site although I am pleased to say that the new lights do seem to be working okay

The roadside verge by the Spooner level crossing is being extensively damaged by contractor vehicles assciated with the new crossing works and there is hole in the path on the Eastern ( Church ) side which is probably associated.

by trying to avoid the cracks, holes and slippery mud on this stretch of path, you can end up scratched by the overgrown brambles from the uncut hedge alongside. I nearly fell over last week when the prickles from the encroaching brambles stuck and tangled to my legs. The bad condition of this footpath with the unmaintained brambles is turning this path into an obstacle course.

Dear Mr Halls,

 

I am sorry that you were unable to open my earlier email. Unfortunately all emails that contain information classed as personal data under data protection legislation need either to be sent to a known secure address or sent encrypted. They can only be sent to email addresses that we do not know to be secure with the explicit consent of the person the "data" is about. In this case the email contained not only your name and email address but also your post code. 

 

I am re sending the email unencrypted as requested. 

 

You are not the only person who has told us that they experience difficulty opening such emails. For this reason we are now monitoring the number of people who tell us about this problem so that we can see if there is a significant need to rethink how we respond to complaints while complying with data protection legislation. I have spoken to the Highway Engineer in our Environment, Transport and Development department responsible for the area who tells me that the work is being undertaken by Network Rail who are therefore responsible for making good the damage to the verge and path. He will be brining the matter to the attention of his contact in Network Rail to make them aware so that they can complete the work to a satisfactory standard.

So let me paraphrase

'Not our problem'

The unfortunate fact is that it their problem to deal with but they do not have the resources or manpower to deal with so they attempt to  abidicate. The reality is that they cannot abdicate and Net work rail would simply say that they were not responsible (alone ) So if you have a problem or accident sue NCC

You may think I have been harse but by placing this message on the board there is no doubt about them being unaware and oddly it will help them as the party line is that services are not being affected by the cuts , when in fact they (NCC ) know they are, but cannot say so. So it up to us.

A man with a sharp spade, a pair of secateurs and 30 mins will sort this, plus of course some later work to fill the ever increasing hole and would it not have been nice to say that and actually do something. The brambles is another but entirely relevant issue linked to this , which is entirely NCC to deal with.

So once again we are left with the fact that nothing will happen until someone has an accident

Maybe one of our two local gardening businesses would be community minded enough to stop on their way past the brambles and tidy them up for the mutual benefit of all village residents.

They shouldn't have to but we will be waiting a long time before the appropriate authorities do anything!

The path is bad and needs attention, but I'm fed up with all the brambles and weeds overhanging onto the path.  Isn't the landowner or landmanager the same farmer who has put in the planning application to build all those new houses in Chapel Road and Bunwell Road? The ditch next to the path is full and hasn't been cleared for years. I suppose there is no money to be made in keeping the path safe and ditch clear.

Update on the state of the path and notice of some much overdue repairs JLH Posted this date 21/5/13

 

Dear Mr Halls,

 

The Highway Engineer responsible for the area has now had the opportunity to return to site adjacent to Spooner level crossing and has confirmed that repairs to potholes in the footway and carriageway were commissioned to start early week. He has also asked me to let you know that our Environment, Transport and Development department will be carrying out a structural maintenance footway scheme to refurbish the existing footway as part of the 2013/14 Construction Programme. This should mean that any further existing damage to the verge/footway will be fully repaired later this year.

 

May I again thank you for bringing this matter to my attention. I trust that the information provided by the Highway Engineer provides you with some assurance that Norfolk County Council are working to achieve your desired outcome as identified on the original complaint form submitted.

To say that I am sorry that you have had to complain a second time may sound hollow but it is true. Unfortunately the Highway Engineer responsible for the area is not available for about two to three weeks. I have arranged that as soon as he returns he is made aware of you comments so that the work undertaken by Network rail can be inspected and if necessary that they can be asked to bring it up to n acceptable standard. I will contact you again once I know more.

Just to let you know that Network rail have now completed the works to the Station  and that the damage to the verge , the hole in the path on the opposite side to the school, the damage to the road on the school side which was repaired is now worse than ever and that it would appear that no repairs of any kind have taken place
